1.2. “End-User(s)” means any person or entity other than the Subscriber or the Authorized Users whose data is transmitted by or on behalf of the Subscriber to the Fyno Solution.
1.3. “License Agreement” means the agreement which governs Subscriber’s access and use of the Fyno Solutions.
1.4. “Personal Information” means any information relating to an identified or identifiable natural person; an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.
1.5. “Processor” means a natural or legal person, public authority, agency, or other body which processes Personal Information on behalf of the Controller.
1.6. “Subscriber” means the person that has subscribed to Fyno Solutions by entering into an Agreement.
1.7. “Website” means the websites that We own and operate, including https://fyno.io/.

We have in place a secure server for all Your Personal Information which, if required to be accessed, are accessible only by Our authorized personnel. 7. Exclusion
7.1. End-User Exclusions. Fyno Solutions is intended for use by businesses. This Privacy Policy is not applicable to Our processing of any Personal Information forming a part of the Client Data. We may receive End-Users’ Personal Information as a part of the Client Data for which We will only act as a Processor and such processing will be governed by the Agreement. In such a case, the End-User’s data privacy questions and requests should be submitted to the Subscriber in its capacity as a Controller. We are not responsible for Subscribers’ privacy or security practices which may be different from this notice. Subscribers of Fyno Solutions are solely responsible for establishing policies for and ensuring compliance with all applicable laws and regulations, as well as any and all privacy policies, agreements, or other obligations, relating to the collection of Personal Information in connection with the use Fyno Solutions by the Subscriber.
7.2. Link to third party sites. Our Website may provide third party information and links to other platforms that are not affiliates of or operated or controlled by Us including but not limited to payment gateways or social networking platforms. We are not responsible for any form of transmission, whatsoever, received by You from any third-party platform and accordingly do not make any representations concerning the privacy practices or other policies of such third-party platforms. Under no circumstances shall We be deemed to control or guarantee the accuracy, integrity, or quality of the information, data, text, software, sound, photographs, graphics, videos, cookies, messages or other materials available on such platforms. Any information provided by You to such third-party platforms shall be governed in accordance with the privacy policies of such platforms and it is recommended that You review the privacy policy of such platforms prior to using such platforms.
8. Retention of Personal Information
8.1. Once you delete your Personal Information through your account settings such as name and e-mail address on the Website, this deleted information is not stored in any form at our end. We retain Personal Information collected only where an ongoing legitimate business requires retention of such Personal Information such as to defend or pursue legal claims, to fulfil any surviving obligations arising from a contract, to provide You with information regarding Our products or Fyno Solutions, or to comply with any legal, tax or accounting requirements. Our data retention policy specifies that the data stored in the form of logs on our application, will be maintained for a period of 6 months from its generation and subsequently destroyed. In the absence of a need to retain Personal Information as described above, We will either delete it or anonymize it, or, if this is not technically possible then We will securely store Your Personal Information and isolate it from any further processing until deletion is possible.
8.2. You have every right to cease to hold an account with us. However, the past activity data associated with your account is intact in anonymous form with us and we may utilise it for research and analysis purposes in order to improve the quality of Fyno Solutions.

9.1. We mainly process Personal Information in India. However, We may transfer Personal Information outside these regions only for the purposes referred to in Clause 2. We will ensure that the recipient of Your Personal Information offers an adequate level of protection that is at least comparable to that which is provided under applicable data protection laws.
9.2. If You are a resident of the European Economic Area and when We may share personal data and information with the entities situated outside the European Union. We ensure that your Personal Information is protected and the data recipient adopts an adequate level of data protection, for instance by entering into standard contractual clauses for the transfer of Personal Information as approved by the European Commission (Article 46 General Data Privacy Regulation, 2016), or We will ask You for Your prior consent to such international data transfers.
10. Children’s privacy protection
Fyno Solutions is not for or directed towards children. While We do not intend to and will not knowingly collect any Personal Information from children under the age of eighteen (18) years. Children under the age of eighteen (18) years are prohibited from using Fyno Solutions. If we learn that we have collected information from a child under the age of eighteen (18) years, we will remove that information without undue delay and delete it from our servers (subject to applicable law and this Privacy Policy).
